TAKE NOTICE that under N.J.A.C. 7:36-25.3(m), the Township of Upper has filed a request with the New Jersey Department of Environmental Protection, Green Acres Program proposing to amend the Township’s Recreation and Open Space Inventory (ROSI) to include a 1.43-acre portion of Block 350, Lot 12 located along Mt. Pleasant-Tuckahoe Road (County Route 664) in the Township of Upper, Cape May County. This request is a response to the Green Acres Program’s notice to the Township that it had reason to believe that a portion of Block 350, Lot 12 was held for recreation and conservation purposes at the time the Township of Upper accepted Green Acres Program funding and was erroneously not listed on the Township’s ROSI. 

The Township received Green Acres Program funding on two occasions between 1975 and 1982. As a condition of this funding, the Township was required to list on its ROSI all lands held for recreation and conservation purposes at the time of receipt of Green Acres funding. In its request, the Township indicates that 1.43 acres of the 6.16 acres within Block 350, Lot 12, consisting of one ballfield, a playground and a wooded area around the playground, were held for recreation at a time when the Township received Green Acres funding.  However, this area was omitted from the Township’s ROSIs. The Township further indicates that the remaining 4.73 acres of Block 350, Lot 12 were held for general municipal uses, including but not limited to a municipal building (now vacant) and a public works yard, and therefore, should still be omitted from the Township’s ROSI.  

The Township’s request, including an accompanying survey depicting the 1.43-acre area, and the prior Green Acres Program decisions on Block 350, Lot 12 are available for public inspection on the Green Acres Program website at and in person at the Township of Upper Municipal Offices, 2100 Tuckahoe Road, Petersburg, New Jersey 08270 and the NJDEP Green Acres Program Office at 501 East State Street, Trenton, New Jersey 08625-0420. 

The Green Acres Program is soliciting public input on the Township’s request and encourages the public to provide any information it may have regarding the historic use Block 350, Lot 12 prior to 1982.  Written input on the ROSI amendment request may be directed to the New Jersey Department of Environmental Protection, Green Acres Program, Bureau of Legal Services and Stewardship, Mail Code 501-01, P.O. Public input on this ROSI amendment request will be accepted until March 20, 2017. On or after March 21, 2017, the Department of Environmental Protection may take formal action on the ROSI amendment request.
